Unless expressly stated otherwise, VPS Advisor does not sell, provision, operate, or directly manage the VPS, cloud, hosting, or infrastructure services listed on the platform.

2. Eligibility

You may use VPS Advisor only if you are legally capable of entering into a binding agreement under the laws applicable to you.

If you use VPS Advisor on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

If you are using the Services on behalf of another person or organization, references to "you" include that person or organization.

Information may come from providers, users, public sources, automated systems, network measurements, community contributors, or other sources.

Provider information may change

Provider pricing, specifications, availability, locations, policies, network configurations, and service offerings may change without notice.

VPS Advisor does not guarantee that every provider listing is complete, current, accurate, or error-free at all times.

Users should independently verify important information with the provider before purchasing or relying on a service.

9. Provider Relationships

The presence of a provider on VPS Advisor does not necessarily mean that VPS Advisor endorses, certifies, guarantees, or recommends that provider.

Likewise, the absence of a provider from VPS Advisor does not mean that VPS Advisor considers that provider unsuitable.

Unless explicitly stated otherwise, VPS Advisor is not a party to agreements between users and providers.

Any purchase, subscription, hosting agreement, support arrangement, refund, cancellation, dispute, or other transaction between you and a provider is between you and that provider.

10. Third-Party Services

VPS Advisor may link to or integrate with third-party websites and services.

Third-party services may include:

  • VPS providers.
  • Cloud providers.
  • Hosting companies.
  • Payment services.
  • Analytics services.
  • Authentication services.
  • External documentation.
  • Other websites and applications.

We do not control third-party services and are not responsible for their:

  • Availability.
  • Content.
  • Security.
  • Privacy practices.
  • Pricing.
  • Performance.
  • Policies.
  • Products or services.

Your use of a third-party service is subject to that service's own terms and policies.

11. Reviews and Ratings

VPS Advisor may allow users to submit reviews, ratings, comments, and other feedback about providers.

Reviews are intended to represent the experience or opinion of the person who submitted them.

You must provide genuine feedback

You agree that reviews and ratings you submit must:

  • Be based on your genuine experience or reasonable knowledge.
  • Be truthful and not intentionally misleading.
  • Relate to the provider or service being reviewed.
  • Not contain fabricated experiences.
  • Not be submitted in exchange for undisclosed compensation.
  • Not be submitted for the purpose of artificially manipulating ratings.
  • Not impersonate another person.
  • Not contain unlawful or harmful content.

You must not submit multiple reviews for the purpose of artificially increasing or decreasing a provider's rating.

12. Review Manipulation

VPS Advisor may investigate activity that appears to manipulate reviews, ratings, rankings, or provider reputation.

We may take actions including:

  • Removing reviews.
  • Restricting visibility.
  • Adjusting or recalculating ratings.
  • Suspending accounts.
  • Restricting review privileges.
  • Requesting additional verification.
  • Restricting provider or contributor access.

We are not required to disclose all internal fraud-detection or moderation methods because doing so could make the platform easier to manipulate.

13. Review Verification

VPS Advisor may introduce verification mechanisms to improve review reliability.

Verification may include:

  • Account verification.
  • Email verification.
  • Purchase or subscription evidence where supported.
  • Provider interaction evidence.
  • Technical verification.
  • Other reasonable verification methods.

Verification does not necessarily mean that VPS Advisor independently guarantees the truthfulness of every statement in a review.

A review that is not verified should not automatically be interpreted as false.

14. Provider Responses

Where supported, providers may respond to reviews or other public feedback.

Provider responses must comply with these Terms and must not:

  • Harass reviewers.
  • Threaten users.
  • Publish private information.
  • Attempt to identify anonymous reviewers improperly.
  • Submit fraudulent information.
  • Manipulate ratings.

VPS Advisor may moderate provider responses in accordance with these Terms.

15. User-Generated Content

You may submit content to VPS Advisor, including:

  • Reviews.
  • Ratings.
  • Comments.
  • Provider information.
  • Feedback.
  • Images.
  • Documents.
  • Responses.
  • Other material supported by the Services.

You retain ownership of content that you own and submit to VPS Advisor.

However, by submitting content, you grant VPS Advisor a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, modify, adapt, format, translate, and otherwise use that content as reasonably necessary to operate, promote, improve, and provide the Services.

This license continues for as long as necessary for VPS Advisor to operate the relevant Services and to maintain legitimate records, subject to applicable law.

16. Your Responsibility for Submitted Content

You are responsible for the content you submit.

You represent that:

  • You have the right to submit the content.
  • The content does not unlawfully infringe another person's rights.
  • The content is not intentionally deceptive.
  • The content does not contain malicious code.
  • You have obtained any permissions required to use personal information or material belonging to another person.
  • Submission of the content does not violate another agreement to which you are subject.

You should not upload confidential information that you are not authorized to disclose.

17. Prohibited Content

You must not submit content that:

We may remove or restrict content that violates these Terms or creates a risk to VPS Advisor, users, providers, or third parties.

18. Content Moderation

VPS Advisor may review, moderate, restrict, remove, or disable access to content where we reasonably believe it:

  • Violates these Terms.
  • Violates applicable law.
  • Is fraudulent or manipulated.
  • Creates a security risk.
  • Harms the integrity of the platform.
  • Contains prohibited personal information.
  • Is spam.
  • Is otherwise inappropriate for the relevant feature.

We may use automated systems, human reviewers, community workers, or other methods to identify potentially problematic activity.

We do not guarantee that all prohibited content will be detected.

19. Provider Management

Where VPS Advisor allows providers or authorized representatives to manage their profiles, those users may be permitted to:

  • Claim a provider profile.
  • Update company information.
  • Submit service information.
  • Respond to reviews.
  • Request corrections.
  • Manage provider-related content.
  • Access provider-specific features.

A person claiming to represent a provider must have appropriate authorization.

VPS Advisor may request evidence of authorization before granting or maintaining provider-management privileges.

20. Community Workers and Contributors

VPS Advisor may provide community-worker or contributor functionality for eligible participants.

Community workers may assist with activities such as:

  • Network monitoring.
  • Service verification.
  • Technical observations.
  • Provider data verification.
  • Other platform-supported tasks.

Participation may be subject to additional rules.

You must not use contributor functionality to:

  • Attack or disrupt third-party systems.
  • Conduct unauthorized security testing.
  • Perform denial-of-service activity.
  • Circumvent access controls.
  • Collect information that you are not authorized to collect.
  • Misrepresent monitoring results.
  • Manipulate provider scores or rankings.
  • Submit fabricated observations.

You are responsible for ensuring that your participation complies with applicable laws and the authorization provided by VPS Advisor.

21. Network Monitoring

VPS Advisor may use automated systems and community contributors to collect network-health information.

Monitoring may involve public network infrastructure and technical measurements such as:

  • Network reachability.
  • Latency.
  • Routing information.
  • IP addresses.
  • Autonomous System information.
  • Regional observations.
  • Availability measurements.

Monitoring results may be affected by:

  • Internet routing.
  • Geographic location.
  • Network congestion.
  • Temporary outages.
  • Measurement methodology.
  • Probe availability.
  • Changes in provider infrastructure.
  • Third-party network conditions.

Therefore, monitoring results should be interpreted as measurements or observations rather than absolute guarantees of provider performance.

22. No Guarantee of Provider Performance

VPS Advisor does not guarantee that any provider:

  • Will remain operational.
  • Will maintain advertised speeds.
  • Will maintain advertised uptime.
  • Will provide uninterrupted service.
  • Will maintain pricing.
  • Will retain a particular network configuration.
  • Will protect your data.
  • Will provide satisfactory customer support.

Any performance information displayed by VPS Advisor is provided for informational and comparison purposes unless explicitly stated otherwise.

23. No Professional or Technical Advice

Information provided through VPS Advisor is generally informational.

It should not be treated as:

  • Professional advice.
  • Legal advice.
  • Financial advice.
  • Security advice.
  • Guaranteed technical advice.
  • A guarantee that a particular provider or product is suitable for your requirements.

You are responsible for evaluating providers and determining whether a service is appropriate for your needs.

24. Pricing and Availability

Provider pricing and availability may change.

Prices displayed on VPS Advisor may:

  • Become outdated.
  • Exclude taxes.
  • Exclude additional fees.
  • Reflect promotional pricing.
  • Differ by location.
  • Differ by billing period.
  • Differ from prices displayed by the provider.

Always confirm current pricing, billing terms, availability, renewal prices, and applicable fees directly with the provider before purchasing.

25. Intellectual Property

The VPS Advisor platform and its original materials are protected by applicable intellectual-property laws.

Except for content submitted by users or third-party content, VPS Advisor or its licensors may own rights in:

  • Website design.
  • Software.
  • Source code.
  • User interfaces.
  • Logos.
  • Branding.
  • Graphics.
  • Platform-generated data.
  • Documentation.
  • Original text.
  • Databases and database structures.
  • Other proprietary materials.

You may not reproduce, distribute, modify, sell, license, or commercially exploit VPS Advisor materials without authorization, except where permitted by law.

26. VPS Advisor Trademark and Branding

VPS Advisor names, logos, trademarks, service marks, and branding may not be used in a way that implies an unauthorized relationship, endorsement, sponsorship, or partnership.

You may not use VPS Advisor branding to create a confusingly similar service or website without written authorization.

27. Acceptable Use

You agree to use VPS Advisor only for lawful purposes and in accordance with these Terms.

You must not:

  • Attempt to gain unauthorized access to our systems.
  • Circumvent security controls.
  • Probe or attack VPS Advisor infrastructure without authorization.
  • Introduce malware.
  • Conduct denial-of-service attacks.

28. Automated Access and Scraping

30. Availability of the Services

We aim to provide reliable Services but do not guarantee uninterrupted availability.

The Services may become unavailable because of:

  • Network problems.

  • Software errors.
  • Third-party service failures.
  • Internet outages.
  • Events beyond our reasonable control.

We may perform scheduled or emergency maintenance without prior notice where necessary.

31. Disclaimers

To the maximum extent permitted by applicable law, VPS Advisor is provided on an "as is" and "as available" basis.

We do not warrant that:

  • The Services will always be available.
  • Information will always be accurate or current.
  • Provider listings will always be complete.
  • Reviews will always be genuine despite our moderation efforts.
  • Monitoring results will always be accurate.
  • Search results will always be complete.
  • The Services will be free from errors.
  • The Services will meet every user's requirements.
  • The platform will be free from security vulnerabilities.

You use VPS Advisor at your own discretion and risk.

32. Third-Party Provider Disclaimer

VPS Advisor does not control the services offered by providers listed on the platform.

We are not responsible for:

  • Provider outages.
  • Server failures.
  • Data loss.
  • Security incidents involving a provider.
  • Billing disputes.
  • Refund disputes.
  • Provider support.
  • Provider terms.
  • Provider privacy practices.
  • Provider performance.
  • Provider conduct.

Any dispute concerning a provider's service should generally be addressed directly with that provider.

33. Limitation of Liability

To the maximum extent permitted by applicable law, VPS Advisor and its owners, operators, employees, contractors, affiliates, partners, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

  • Your use or inability to use the Services.
  • Your reliance on provider information.
  • Your relationship with a provider.
  • Provider service failures.
  • Loss of data.
  • Loss of profits.
  • Loss of business opportunities.
  • Security incidents.
  • Third-party services.
  • User-generated content.
  • Monitoring information.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

34. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless VPS Advisor and its owners, operators, employees, contractors, affiliates, and service providers from claims, damages, liabilities, costs, and expenses arising from:

35. Suspension and Termination

Some provisions of these Terms may continue after termination where their nature requires continued application.

36. Deleting Your Account

Where account deletion functionality is available, you may request deletion of your account.

Account deletion does not necessarily remove:

  • Aggregated or anonymized information.
  • Records that we are legally required to retain.
  • Information necessary for fraud prevention or security.
  • Records necessary to resolve disputes.
  • Other information that may legitimately be retained under applicable law.

Where appropriate, we may anonymize or disassociate user-generated content from your account rather than permanently deleting the content.

37. Feedback

If you provide suggestions, ideas, recommendations, or other feedback about VPS Advisor, you agree that we may use that feedback without restriction or compensation to you.

Providing feedback does not transfer ownership of intellectual property that you independently own unless otherwise agreed.

If you believe that content on VPS Advisor infringes your copyright or other intellectual-property rights, please contact us with sufficient information to identify:

  • The copyrighted work or protected material.
  • The allegedly infringing material.
  • Your contact information.
  • Evidence of your ownership or authorization.
  • The basis for your claim.

We may remove or restrict content where appropriate and legally required.

42. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to the legal entity operating VPS Advisor, without regard to conflict-of-law principles.

The governing law is the law of the jurisdiction in which that entity is established, and a reference in these Terms to the applicable jurisdiction means that jurisdiction. Where mandatory law in your country of residence gives you rights that this section would otherwise remove, those rights are unaffected.

43. Dispute Resolution

Before commencing formal proceedings, you agree to give VPS Advisor a reasonable opportunity to investigate and resolve a dispute by contacting us.

Where a dispute cannot be resolved informally, it will be handled in accordance with the applicable laws and jurisdiction specified in these Terms.

Those proceedings are brought before the courts having jurisdiction in the place where the legal entity operating VPS Advisor is established, and both parties submit to the jurisdiction of those courts. This does not prevent you from bringing proceedings in the courts of your country of residence where the law of that country gives you the right to do so, and it does not prevent either party from applying to any court of competent jurisdiction for urgent or injunctive relief.

44. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, while the remaining provisions will continue in effect.

45. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

46. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the agreement between you and VPS Advisor concerning your use of the Services.

They supersede previous agreements or understandings concerning the same subject matter, except where expressly stated otherwise.

47. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or other lawful business transaction.
